Could someone explain the difference between Skype and VOIP? Why isn't Skype banned in this country?

(Disclaimer: I'm not advocating banning Skype, just wanted to know why it's not classified as a VoIP)

As far as I know routing international phone calls through voip is illegal, as it bypasses the govt ISD tarrif, but still charges the caller. Talking on internet for free, or by charging directly for the internet call is not illegal. But I might be wrong.
