Battlefield vs. Call of Duty Showdown Rules

PROMOTION RULES:
By entering this Promotion, you agree that you have read and accepted all of these rules.
NO PURCHASE NECESSARY. Event open worldwide. Void where prohibited by law. Check your local law and regulations concerning sweepstakes or giveaway events. By entering you agree to receive email newsletters regarding the status of this promotion only. You may opt-out of these newsletters at any time.
ELIGIBILITY: Entry open to any registered user holding a Raptr account in good standing. A valid Raptr account must have a valid email address associated. A Raptr account may be established without purchase (http://www.raptr.com). Must be eighteen (18) years or older (or the age of majority under the laws of the country or state of residence) to enter.
Employees of Raptr, promotional partners, prize providers, and immediate family members of such employees, are not eligible to enter.
ENTRY:
Phase 1 – War of Words
Any eligible Raptr user (see GENERAL RULES) will be granted an entry into the Promotion when he or she visits the Battlefield vs. Call of Duty event topic page(http://raptr.com/topic/bfvscod/about) (http://blog.raptr.com/2011/10/06/bat...mpaign=bfvscod) , and leaves a comment on any of the official poll questions posted there. Additional entry is granted for following the topic page. To follow the topic page, visit the event topic page and click “Follow” on the top right hand column. Only one entry per account per question. Multiple comments from a single account on a same question will be counted as one entry. The promotion period begins at 01:00:01 AM Pacific Daylight Savings Time on October 17, 2011, and ends at Midnight, November 20, 2011.
Phase 2 – Playtime Showdown
Any eligible Raptr user (see GENERAL RULES) will be granted an entry into the Promotion when he or she downloads the Raptr client (http://raptr.com/download) and plays the game of either Battlefield 3 or Call of Duty: Modern Warfare 3, on either Xbox 360, or PC for any length of time between the promotion period. The promotion period begins at 01:00:01 AM Pacific Time on October 25, 2011 and ends at Midnight, December 6, 2011. Entrants are automatically entered into each prize pool, based on how many hours each entrant plays either Battlefield 3 or Call of Duty: Modern Warfare 3. Each entrant must ensure that his/her hours are being accurately tracked by Raptr by downloading and having the Raptr client running while playing the games. Hours added via Raptr’s “manually add gametime” function do not count towards individual prizes.
Phase 3 – Achievements / Trophies Showdown
Any eligible Raptr user (see GENERAL RULES) will be granted an entry into the Promotion when he or she downloads the Raptr client (http://raptr.com/download) and unlocks the eligible Achievements for Xbox 360, or Trophies for Playstation 3, as defined by the promotion, between the promotion period. The promotion period begins at 01:00:01 AM Pacific Time on October 25, 2011 and ends at Midnight, December 6, 2011. Each entrant must ensure that his/her achievements/trophies are being accurately tracked by Raptr by downloading and having the Raptr client running while playing the games. In the event that external circumstances (such as connectivity issues with Xbox Live or PlayStation Network) prevent or impede Raptr’s ability to track gameplay and or Achievements / Trophies, Raptr reserves the right to modify the event rules.
GENERAL RULES. Entry open to any registered user holding a Raptr account in good standing. A valid Raptr account must have a valid email address associated. A Raptr account may be established without purchase (http://www.raptr.com). Each prize winner must be eighteen (18) years or older (or the age of majority under the laws of the country or state of residence), and will be further required to submit an affidavit of eligibility and a liability/publicity release and confirmation that the prize winner has followed the rules of the Promotion, in the form supplied by Raptr (the “Affidavit and Release”), signed by the prize winner. The Affidavit and Release must be signed and returned within fourteen (14) days of receipt. In the event the Affidavit and Release is not returned as described above, an alternate winner may be selected for such prize. Any prize notification or prize returned to the Raptr as undeliverable will result in the awarding of that prize to an alternate winner (who will be required to comply with similar procedures).
This Promotion is subject to all applicable laws and is void where prohibited. By participating in this Promotion, entrant agrees to abide by and be bound by these rules and the decision of Raptr, which shall be final and binding. All submissions become the sole property of Raptr and will not be acknowledged or returned.
DISQUALIFICATIONS: Creating multiple Raptr accounts for the sole purpose of entering into the promotion may be cause for disqualification. Crude, offensive, racial, discriminatory, or otherwise inappropriate comments will be deleted, and the entry by the commentor disqualified at Raptr’s sole discretion. Any Raptr user deemed to be NOT in good standing or otherwise violates the fair nature of the Promotion will be disqualified.
Anyone engaging in any activity, in or outside of the Promotion, that artificially affects the outcome of the Promotion including, but not limited to the below will be disqualified:

    • A single user creating multiple Raptr accounts based on different emails.
    • A single user using multiple Raptr accounts based on different emails to gain multiple entries to the Promotion or manipulate the number of votes an entry has.
    • Encouraging other Raptr users to manipulate the number of votes an entry has in exchange for other goods or services.
    • Encouraging other Raptr users that are not immediate friends or family to manipulate the number of votes an entry has regardless of the quality of the content
Raptr reserves the right to disqualify any entry for any reason, in its sole and absolute discretion.

By entering the Promotion, entrants acknowledge compliance with these rules (including without limitation all eligibility requirements). In the event of any dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Potential winners may be requested to provide Raptr with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry. If for any reason (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Raptr which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this ) the promotion is not capable of being conducted as described in these rules, Raptr shall have the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion. Raptr assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Raptr is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Raptr on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to participant’s or any other person’s computer related to or resulting from participating or downloading any materials in this Promotion. ALTERNATIVE MEANS OF ENTRY: Entrants may also enter the promotion by mailing a standard-size postcard with your name and email address to: Raptr Promotions, c/o Raptr, Inc. 701 N Shoreline Ave, Mountain View, CA 94043. Postcard entries must be postmarked during the Promotion Period to be qualified. Only one post card per question will qualify as an entry. One may also submit answers to multiple questions on one post card.
PUBLICITY. By entering the Promotion, entrants and prize winners grant Raptr permission to use his or her name, address, email address, photograph and likeness, voice and entry for advertising, publicity or other purposes without additional consent or compensation except where prohibited by law. WINNERS: By December 16th, 2011, Raptr will select and announce all winners. Winners will be notified by e-mail and must respond within 14 calendar days or an alternate winner will be chosen.
Phase 1 – Winner of the Custom-Built PC will be selected at random among the entrants who left at least one comment in favor of the game (either Battlefield 3 or Call of Duty: Modern Warfare 3) that is declared to be the winner by Raptr. Odds of winning depend on number of eligible entries received.
Phase 2 – For Xbox360 and PC versions of the games only. Winners will be selected at random among entrants who achieve milestones defined by Raptr through playing either Battlefield 3 or Call of Duty: Modern Warfare 3.

PRIZES: All prizes will be shipped to the winners within 6-12 weeks of the receipt of signed affidavits for approved entry. In the event that a prize is not available such as cancellation or termination of release or sale of the prize by the manufacturer or prize provider, Raptr reserves the right to substitute prizes for cash or other goods or services. Raptr is not liable or responsible for prizes provided by partners who become unable to fulfill the prize commitments. Raptr reserves the right to substitute or change the prize to other goods or services of equal or similar value without prior notice.
Prizes will not be replaced if lost or stolen, and are not transferable or redeemable for cash. Winners are responsible for all applicable taxes.
